Purpose and Scope

Use our services, systems, or solutions that may be made available for free or for a fee;
Apply for or maintain membership of Trading Participants as our Clearing Members ("CM");
Apply for or maintain accreditation as settlement banks ("SB") for clearing and settlement of cash element of SCCP-Eligible Trades or connect with us through the messaging system, or submit request forms;
Submit reports, comply with our policies, rules, or circulars, request data, training, or assistance, or when we conduct industry wide testing ("IWT") of new system;
Apply for employment, appointment, or training or are employed, appointed, or contracted;
Supply us with your products, solutions, or services or when you respond to our bid invitation for supplies, solutions, or services;
Attend meetings, trainings, or events hosted by us, or visit our offices;
Email, message, call, or contact us for business or legitimate concerns, or make deliveries;
Visit, access, use, or download from our website (www.sccp.com.ph); or
Access, register to use, maintain user account, generate reports, add user/s, or use the SCCP CM Report System/SCCP Clearing Member Generator Portal and Clearing & Settlement System ("C&S System") (collectively, "SCCP Online Platforms");

Personal Data that SCCP collects and processes

To fulfil our contractual obligations, for example allow you to supply us with your products, solutions, or services, or allow you to use our services, solutions, or systems;
To comply with our legal and/or regulatory obligations, for example obtaining your name to enable us to meet our obligations under the Securities Regulation Code ("SRC") or for clearing and settlement of CM trades;
To meet our legitimate interests, for example we want to know how you use our website or SCCP Online Platforms in order for us to enhance our services, solutions, or systems, or to create new ones; convey the issues or concerns relating to your application or CM user account; provide update about SCCP Online Platforms or services that you use; maintain our records; and review and plan our marketing and business development programs or technology enhancements. When we process personal data based on this ground, we implement necessary safeguards which are designed to protect your privacy interests, freedoms, and fundamental rights protected under the 1987 Constitution;
When processing of your personal data is provided for by existing laws and regulations such as in relation to your employment or for compliance by CMs, PSE, or by SCCP with the SRC, 2015 Implementing Rules and Regulations ("2015 SRC IRR"), our Rules, and other applicable laws and regulations; and
When we are required to obtain your consent by law, for example when we process sensitive personal information, when there is data sharing, or in relation to direct marketing activities. If we ask for your consent to process your personal data, you may withdraw your consent at any time by contacting us using the details at the end of this Privacy Policy. If consent is withdrawn, we will be constrained to terminate processing of your transaction, application, accreditation, CM user account, or request unless there is legal basis for further processing of your personal data without need of your consent.

Full name, nickname, addresses (email, office, and residential), zip code, contact numbers (home, office, fax, and mobile), title or job title, or designation;
Photographs, video footages through closed-circuit television system, signature, gender, religion, employee number, company name and address, and community tax certificate number;
Payroll information, payroll history, financial benefits, rank, bank account number, loan records, tax account number, tax status, income tax returns, and other financial information;
Citizenship, nationality, information appearing on government-issued ID or company ID, birthday, birthplace, age, blood type, civil status, offenses, education and family background, affiliated organizations, health data, employment history, work experience, and other curriculum-vitae related information;
Government-issued numbers such as license numbers issued by Securities and Exchange Commission ("SEC"), Social Security System, Philhealth, Pag-ibig, Professional Regulation Commission; driver's license, Roll of Attorney's number, and passport information;
Username, password, information about your use of the website or SCCP Online Platforms, including cookies and internet protocol ("IP") address; and
Any additional personal data that you may provide through your correspondence(s) or communication with us in connection with your concerns which we shall also consider and treat as personal data.

Directly from you or from your duly-authorized representative, or from PSE, external auditor, or third-party providers (collectively, "Related Parties"), collected and disclosed with your consent or authorization;
From Clearing Members, accredited Settlement Banks, Philippine Depository and Trust Corporation ("PDTC"), or third-parties such as service providers to whom you have given consent to transmit your personal data to SCCP;
Through contracts, agreements, or other legal arrangements you or your authorized person has with SCCP or Related Parties or through CCTV; or
When you browse our website or use SCCP Online Platforms, we and our third-party providers use cookies to store information about how you use the website or SCCP Online Platforms in order to enhance your user experience and to improve the quality of service provided to you. Examples of this information may include your IP address, type of browser and operating system that you are using, domain name, date and time of your use of our website or SCCP Online Platforms, and the route you used to access it. Purposes of the collection, use, storage, and disclosure of personal data

Provide you with our services, solutions, or systems; allow your participation in trainings, seminars, webinars, or IWTs; or in order for us to improve our services, solutions, or systems;
Clearing and settlement of CM transactions of securities listed with PSE;
Undertake review and evaluation of applications submitted to SCCP and to provide update on said applications, CM membership, or SB accreditation, including conduct of background checks about you, when necessary or required;
Convey matters pertinent to your relationship with or interest in SCCP or to act on your request/s or applications;
Fulfil contractual or legal obligations under the contract, agreement, or other legal arrangement entered into between you and SCCP or with PSE;
Conduct audit and review of our processes and systems for purposes of managing risks, strategic and action planning, and compliance;
Protect and enforce contractual and legal rights and obligations of SCCP and to allow SCCP's compliance therewith;
Comply with applicable laws, rules and regulations, circulars, codes of practice or corporate governance, guidelines, or policies issued by regulatory bodies, or to assist in law enforcement investigations or inquiries by SEC or by relevant authorities, including assistance in court proceedings when there is a subpoena;
Prevent, detect, and investigate offenses, crimes, or violations of our policies, SCCP Rules, or applicable laws or regulations, including assessment and management of business risks arising from said offenses or violations;
Manage the safety and security of SCCP premises, information communication technologies, data, systems, services, our personnel, third-party services providers' staff, and guests;
Send you information about our services, events, trainings, or IWTs that may be relevant to you;
Allow your visit to our premises or attend meetings or events;
Implement and enforce SCCP Rules, PSE Rules, memorandum circulars, guidelines, policies, and other issuances of SCCP, PSE, and SEC and, when applicable, for compliance purposes by TPs with the foregoing; and
Any other purposes necessarily related or incidental to any of the foregoing.

Rights under the Data Privacy Act

Right to be informed of the processing of your personal data;
